Lawsuit alleges school made people sick

 
LEE COUNTY, November 10, 2003— More than twenty people are part of a lawsuit against the Lee County School Board. The suit claims mold, mildew, yeast and dangerous levels of carbon dioxide and other contaminants might have made people sick at Gateway Elementary School.
Fred Kobie said his son was sick.

"My youngest son was ill every day. We literally had to pull over after we picked him up so he could throw up," said Kobie.

The lawsuit blames the alleged mold problem on the air conditioning system. The people suing claim the air conditioning system was never supposed to be shut off.

School officials acknowledge the air conditioning system was supposed to run around the clock. But they can't provide the paperwork to prove the system never failed.

The lawsuit claims gross negligence on the part of the principal and the administrative staff. It states they are responsible for a list of health problems that prompted chronic allergy attacks and headaches in children.

"I don't know what they've done since I've left. I know I'm not going to send my kids back to that school," said Kobie.

Parents like Kobie say they want resolution even if it means heading to court.

The people suing are seeking class action status, asking the courts to include anyone who may have attended or worked at Gateway Elementary in the past 3 years.

Included in the suits are at least four men who claim loss of consortium. Meaning they or their spouses were so sick, they were not able to have sex.
