board, builders sued over mold infestations at 2 schools FORT LAUDERDALE – Lawsuits have been filed against the Broward School
Board and builders over alleged toxic mold and its effects over the
past 14 years at two elementary schools in Broward County. The suits were announced at a 2 p.m. Friday press conference at the Fort Lauderdale law office of J. Scott Gunn. Two plaintiffs in the suits, Molina Macfie, of Weston, and Cara Aliseo, of Tamarac, were scheduled to speak, along with their attorneys Scott Gelfand of Boca Raton and Joseph Osborne of West Palm Beach. Riverside and Indian Trace elementaries were named as schools suffering from toxic mold. More lawsuits involving other schools are possible. All the suits allege negligent design and construction and seek damages in excess of $15, 000 for its clients, whom it claims suffer from respiratory problems and other woes because of the mold infestations. The suits, which were filed on Thursday, follow an April grand jury report that alleged deficiencies in school construction more than 10 years ago and claims the school board knew about the mold problems and hid it from the public, says a release prepared by the lawyers. It also claims the suits will document the plaintiffs' suffering with respiratory problems -- missed school, illness, breathing problems, surgery -- as a result of mold, and alleges negligence in attempts to correct the problems. In addition to the school board and School Supt. Frank L. Till Jr., the suit names Schwab, Twitty & Hanser Architectural Group Inc., H. A. Luten & Associates Inc.; QRS Contracting Inc.; Henz Engineering Inc.; ABC Roofer Inc.; XYZ HVAC Inc.; Vaughn, Wunsch, Masullo Architects; Weiss & Woolrich Contracting Co. Inc.; Sal's Abatement Corp.; and Enhealth Environmental Inc. |
